  • I-130 and I-485

    Hello,
Do I have to fill out two separate forms, one for my spouse and one for my stepchild who is 5 y/o or can I just fill out one? Will I also have to pay fees for each one? I saw that on the I-130 on question 17 I can add my stepchild but I'm confused on how to go about the fees and filling out the forms. Any help will be greatly appreciated.

You need separate Adjustment packages and fees for each.

Thank you! But do I have to fill out and pay the fee for a different I-130 for my stepchild? Or just by adding his name on my wife's form and paying just one fee be enough? I will have both 485 ready with the fees but just wanted to make sure if I had to do the same with the I-130.

I answered your question yesterday. Mother and child required separate Adjustment packages and separate fees.

I just re-read your question regarding the I-130 for stepchild. If you are a U.S. citizen petitioner, you will have to submit a separate I-130 for the child.
