    Hi Experts,

    I am USA citizen residing in Virginia. I am planning to file the Green Card for my parents who are residing in INDIA. I was told, by someone, that my parents will get the Green Card soon, may be in 6-9 months.

    I have my younger brother and he in USA on H1b. He is going through a divorce and hopefully everything will get settled soon and he will come out of the divorce. My question here is, can I file his Green Card as well along with my parents? If yes, is there any way that his Green Card can also be processed in the same way as for my parents.

    I will appreciate the answers.

    Hi there,

    You can file for your parents who are currently residing in India, the process (combining both USCIS and NVC) generally takes a year or two at the CURRENT rate scenario.

    You can also file another I-130 for your brother but for siblings which is F4 category, it takes 10 to 14 years currently for processing (between USCIS and NVC).

    You also stated that your brother is currently going through divorce, the processing time for SINGLE siblings and MARRIED siblings is also different. This is because for SINGLE sibling only 1 person (your brother) is legally immigrating vs. Married sibling (the whole family) including children are allowed to immigrate.
