  • AOS from E3 to US resident

    Hi all, I am Australian going through the AOS process. I married in June of this year.

    I am nearing the completion of my package and trying to get some last minute tips/checks to see if I have done everything correctly.

    My initial issue however is with the I-864 form. I have been working with my employer for 10 months, and my wife has just graduated and has only been working 3 months. Therefore we have not filed taxes and have no tax forms to prove income. Will pay stubs be enough?

    Here is everything I have done so far.

    Revised - My AOS Package so far

    I-130;
    - $420 Check
    - Passport of Sponsor
    - Copy of marriage certificate
    - Sponsors birth certificate
    - 2 Passport photos (1 of sponsor, 1 of me)
    - G-325A for both myself and Sponsor
    - Bank statement to show financial connection
    - Health insurance forms to show joint policy
    - Wedding invitation

    I-485;
    - $1070 check
    - Birth Certificate
    - G-325A for Myself
    - Copy of passport
    - Copy of Visa
    - Copy of I-94 admission document
    - 2 passport sized photos
    - Letter of continued employment and income from Employer
    - One pay stub
    - Signed medical Exam form (I-693)

    G-1125 Form

    I-131;
    - Copy of Passport ID Page
    - 2 passport sized photographs

    I-765
    - Copy of I-94
    - Copy of Passport ID page
    - 2 passport sized photographs

    I-864
    - Proof of Citizenship
    - Proof of income (1 pay stub from Spouse's employer, 1 Pay Stub from my employer)

    Appreciate your help
