while i was reading through the instructions of the i485, on Initial Evidence under the the Criminal History.
Im confused about the detainment part of it. Do they mean that being brought in for questioning to the police station or do they mean by stopped by the cops?
Im applying for my greencard now after being married to a us citizen months back. Im under a student visa f1.
I'm confused about the criminal history part because of one incident: I just turned 21 and had about 5 long islands(i didnt know how strong they were till then), and I was drunk. Usually I take a school shuttle back to my apartments because my uni provides free transportation for students around town at night. I vomited on the shuttle on the way back and the driver stopped the shuttle and called the cops and ambulance. I dont know why he did that because he stopped 1 minute away from my apt and I said I was fine after, I was still very conscious. So the cops came and just asked me a few questions took down my student number and check my passport to see if I was legal. The paramedics checked to see if i was okay and I told them i was and had to sign some papers and they let me go home. 2 days later i got an email from the university student conduct office. stating:
I am writing to inform you that the office of Student Conduct received information that you have been
involved in a potential violation of the Student Conduct Code (Revised May 2013). This potential
violation occurred on: mm/dd/yyyy. Due to the nature of the alleged violations (listed below) you have
been assigned to a Campus Conduct Conference. Based on your class schedule you have been assigned to
meet with me, to discuss the details of your incident
Alleged Violations:
F.01.A.08. Public Intoxication
No person shall appear in a state of intoxication in a public place or disturb the peace in any manner while
intoxicated
So i went to explain my situation that is my birthday and had little bit to many drinks with friends. The person said that they wont charge me or with anything and I should be more carefull next time.
Mind you,all I did was vomited on the shuttle and even before vomiting I asked If he could stopped the shuttle to let me out as I didnt feel good and the driver said no and I have seen many students damage school property when drunk( I live 1 minute away from campus).
Do I need to get a statement from the arresting agency ? From who do i get it from?
Also another question,
under the Evidence of Eligibility, I dont get it. I i send them a copy of my student visa FI or what? and what if i dont have the approval notice letter?
Please dont suggest a lawyer, I want answers and instructions to go about this on my own.
