I am a US Citizen planning to file I-130 for my brother and his family who are living in India. I have the following questions:

    - I believe I only need to file one I-130 form with my brother as the primary beneficiary and his family will be derivatives. Is that right?

    - I only need to pay $420 for filing one form I-130 I believe, is that correct?

    - My last name and my brother's last name don't match. Will that be a problem. For example: mine is mallick and his is mallik...father's last name is printed as initial only (M) in the birth certificate..He has a US SSN and its the same on his SSN and US Visa as well (through his employer)

    - In my birth certificate, fathers name is written in full with last name as Initial whereas in his birth certificate its all initials...For example: M Mohd Khan vs M M Khan....Will that cause an issue?

    - In both mine and his birth certificates, mothers first name is only printed and it matches

    - I came to the US on a F1 visa and got my GC via EB based GC and then citizenship. He has traveled to US several times during the same time period through his employer sponsored B1/B2 and L1 visa and it seems he never disclosed on his visa application that his brother lives in the US...I believe there is a question on the visa application...He said his company lawyers told him to answer No and so he answered it that way....Will that cause any issues....

    Appreciate any feedback....

    Hi there,
    - you only need to file one I-130 and name his family members as derivative beneficiaries
    - you only pay ONE fee for ONE I-130
    - The mother's name matches on the birth certificate but there is no full father's name on birth certificate. I suggest you try to compare school leaving certificate, graduation diploma etc to see if your father's name and last name can match as an additional proof. At last, you can create an affidavit stating both of your father's name and last name.
