I married as US citizen and came to the US on a conditional Green card. Unfortunately the marriage is in a divorce proceeding. On the 2 year deadline, I filed a I-751 requesting removal of the conditions on my green card based on the good faith marriage. I have been asked to send the proof of divorce before the interview, however the divorce is taking time as it is contested and I wont be able to get a divorce order before the deadline for giving the proof of divorce. My query is this:
- Can I still send in the divorce order once I get it, even if its after the deadline.
- If I cant send the order by deadline, what happens - do I become out of status or I am automatically moved to deportation
- Is there any way to get additional time, say by sending them copies of the court documents that I am in the divorce process.
- If I cant send the order before deadline and my I-751 is rejected, what is my next best option, to file I-751 again after I get the divorce order ? Do I have to be in the queue again till it comes up for decision or do I move up the queue as I am resending the application again.
