  • Filing I-130 for ill family member - can it be expedited?

    We completed the immigration process for my husband starting with a fiance visa in 2005. He is now a U.S. Citizen. We are interested in assisting his parents with coming to the U.S. from Mexico. His father has been diagnosed with cancer.

    Here are my questions:
    1. Is there any way to expedite the filing so they can come as quickly as possible?
    2. Is there a better form to file in lieu of the I-130?
    3. His father is 58 and his mother is 56. Will they be eligible for any benefits through Medicare or Medicaid upon arrival?

    1. no there is no expedited filing based on medical condition
    2. no other form, they can come visit on visitor visa if they like to
    3. no they are not eligible for Medicare or Medicaid when they come to the US on immigrant visa because through immigrant visa a contract is signed by the sponsor and US government that the sponsor will take care of their expenses. US Government is not responsible to pay for their care/food/housing.
