  • Form I864 (Affidavit of support) -- definition of "Most recent tax year"

    Hi,

I would soon be completing I-864 for a sibling, and have a couple of questions.

    1. Since the W-2 income of petitioner is 5 times the required minimum amount for (petitioner household size + immigrant household size), I do not need to list assets, only income. Is this correct?

    2. My sibling is the principal immigrant, but the spouse and 1 minor child would also be immigrating. Can I fill I864-EZ, or do I have to fill the long form?

    3. Due to complexity of my tax returns, my 2015 taxes won't be filed until October 2016, and a transcript for tax year 2015 won't be available until December, 2016. Is this a problem? If I file I864 in February, 2016, is the most recent tax year 2015, or would 2014 be OK?

If proof of your current employee or net self-employment income (line 22 on page 1 of your form 1040), equals or exceeds the sponsorship requirement, you are okay. Not sure how you came up with income having to be 5 times the sponsorship requirement.

    Use form I-864.

The 2014 Federal tax return is your most recent return, but you will need to include proof of current ongoing income (annualized) meeting or exceeding the sponsorship requirement.
