  • Green card for my dad who was deported 15 years ago

    Hi,
    I was wondering if someone could recommend what to do or if someone has been in the same situation and how it was solved.

    My dad was caught back in 1999 when trying to cross the MEX-US border using a **** green card. He never tried to come back to the US. Now that I am a US Citizen I would like to apply for a green card for him and my mom. (my mom currently has a laser visa to come visit us at the US). Does anyone know what I need to do in order to apply for my dad (besides filling out a I-130)? do I have to mention that incident? if so, is that going to affect the final outcome? he was just caught and sent back to Mexico, no jail time. I would appreciate any feedback on this.

      Petition your dad and expect a final accounting at his Embassy interview. He will probably be told at end of the interview to submit an I-601, waiver from grounds of inadmissibility. His waiver request will be reviewed on its evidence and merits. I had one family friend who was removed and returned to Mexico three times (undocumented entrant). When his wife later petitioned him, he was given a lifetime denial of waiver. Another such family friend left a pregnant wife and child, good job and home, and went to his spousal visa interview at Juarez. He was asked to submit a waiver request and had a strong "humanitarian basis" for approval and got that approval.

      Your dad was removed once, and if he provides proof of an exemplary and productive life during the last 15 years, coupled with evidence of his family in the U.S. needing him, he has as good a chance as any others of being approved.
