  • Help appreciate: help me check my I130 checklist

    Dear all,

I am a green card holder and I am trying to apply for family-based (F2A) green card for my wife who is currently in the U.S. holding H1b work visa. Based on my understanding, I130 is the first step of two steps (the second being 485). I am planning on mailing out the materials for I130 and here is a list of documents in my package. I would really appreciate it if you can help me check whether there is anything missing. Thanks in advance!!!

    1. Application fee $420, using personal check.

    2. Forms (signed and dated)
    - I130
    - G325A for myself
    - G325A for my wife.
    - G1145A

    3. photos. One passport photo of mine and one passport photo of my wife. Both with names in pencil on the back.

    4. Proof of marriage and its bona fide nature
    - Marriage certificate
    - Proof of co-tenancy. A lease of an apartment with both of our names on it.
    - Joint accounts in multiple banks.
    - Affidavits for the bona fide marriage from three different friends. Two of them are witnesses in our wedding ceremony.
    - Photos on the marriage ceremony.
    - Photos of our engagement (proposal).

    5. Proof of my permanent residence
    - Copy of my green card, front and back.
    - Copy of my I797 (welcome notice)
    - Copy of my passport (all pages)
    - Copy of my birth certificate
    - Copy of my driver license

    6. Proof of my wife's identity.
    - Copy of my wife's I797 (for her H1b work visa)
    - Copy of my wife's I94 (attached to the I797)
    - Copy of my wife's passport (all pages)
    - Copy of my wife's birth certificate
    - Copy of my wife's diver license

    Hi Dear,

By reading your comments it seems like you have every thing that you need to file your wife's case. So go ahead and mail it and then wait for USCIS reply.

    Good Luck.....
