I-130 few questions.

Dear Adviser,

I am a Belgian Citizen born in India.
My sister who is a US citizen would like to apply for I-130 for me (her brother).
I have 3 queries:
1. Does US immigration takes my country of birth or nationality when placing in the waiting list.
2. What are the typical waiting time periods for Belgium nationals, if it is considered; as I see they might have quota per country.
3. Can I travel to USA in the mean time for tourism or business or pleasure.
Please advise and throw some light. Thanks in advance.

Hi Mike,

1. US immigration ALWAYS takes your country of birth. Not nationality. My country of birth is India but presently I'm a Canadian. I have a F3 case with them. They changed my consulate from Bombay to Montreal but the processing is done as per the priority dates of India.

2. Only India, China, Philippines and Mexico (practically only Philippines and Mexico) has different priority dates. Belgium falls under " Rest of the World" and the current priority date for your category (F4) is April 2003.

3. Technically you can.
