  • I-130 Green Card Help!

    Afternoon all,

    New to the forum here, my wife ( US citizen )has submitted a I-130, G-325 Biography x2 and E-Notification form also fees photos and bonified marriage documents for me to move to the US with her.
    We sent the documents from the UK on the 21st Jan 16 and they are still sat in customs in LAX which is annoying. I have been told these could be there for up to 30 days.

    Will the USCIS back date to the 21st from when we both signed them or will the process time dtart when they recieve them?

    Also was i meant to send in the I-485 at the same time or can this be sent at a later date?

    As i am in the military i am deploying to California for 3 months, will i be able to do my interview and biometrics test in the US?

    Any help would be great thanks as this is already nerve-racking.

    Ash,

    Though your petition packet may show as sitting in U.S. Customs recently, there is no reason to expect the package to remain there for more than 2 days.

    Since you are being processed in the U.K., you will not need an I-485.

    Your receipt and Priority Date will be when USCIS intakes your I-130, probably around mid-February.

    Unless your I-130 indicated U.S. stateside processing, you will be processed for an immigrant visa in the U.K.
