    I'm petitioning my mom from the Philippines. My problem is she got married twice and never had an annulment with her first which is my dad. She said that her and my dad got separated when I was 1 year old. I grew up with my step dad. With form i130 there's a portion there that I have to put my mom's prior marriage and end of marriage. I actually don't know what to put in there because just like what I have said I grew up with my step dad though I know my real dad's name. And they never annulled. She got married to my step dad 1998, and we found out that my real dad died 2009.

    Include with your petition a copy of the first husband's death certificate, as well as the marriage certificate for mom's second marriage. Though mom married her second husband without the first marriage being terminated, you may have to answer to this anomaly, if asked, by reporting that the annulment documents are not available, but that the death cert is evidence that there is no longer any conflict with her second marriage.

    Before you submit, however, look at your own birth certificate to see if it report mom and your dad being married. Also, have mom obtain a CENOMAR from the NSO to see if the first marriage still shows as a matter of record.
