  • DS-260 Personal Information Question

    Hi,

I'm petitioning my mother and I'm her Agent too. My mom father is a Spanish citizen while her mother is a filipina. My mom has a Spanish Passport and she has Spanish as her Nationality. This is the same passport she will be using when entering USA once her petition is approved. Her Spanish passport middle name has one character different from her birth certificate. On her spanish passport she has "LANQUE" as her middle name while on her Birth Certificate she has "LANGQUE" with a "G" in the middle. The one from her Birth Certificate (which is LANGQUE) is the one we used on her approved I-130. Now I'm working on her Affidavit Of Support and Immigration Visa Application (DS-260).

    Question:
    - Should I be using the middle name from his Spanish passport (LANQUE) since on the Personal Information 1 screen, it says that we should be using exactly what was written in the passport or any travel document that she will be using when entering US (which in her case she will be using her passport)?
    - Her Spanish passport still has her old home address written. The address we used in her approved I-130 is her current and different from passport. Should we be using her current address or the address written from her passport when filing AOS and IV application form?

    Would appreciate any inputs

    Thank you
    Kurt

    1. Use the name as appear on her Spanish passport.
    2. Current address

You can make the affidavit for one and the same person,
This is not a legal advice. Use at your own risk.
