  • HELP: How to answer to this question in Form I-130?

When I was trying to fill out the Form I-130 (see the web-link below) for my current wife. I don't know how to answer the following questions. Could you help me please?

    https://www.uscis.gov/sites/default/files/files/form/i-130.pdf

    D. Other information
    1. If separate petitions are also being submitted for other relatives, give names of each and relationship.

My questions: does the "petitions" here only stand for the I-130 petition or any applications for immigration (i.e., I-140, I-485)? As I am only applying my current wife via I-130 for green card, should my answer be "NO" to this questions? [please refer to my background and current status below]

    2. Have you ever before filed a petition for this or any other alien?
if "Yes,", give name, place and date of filing and result.

Below is my background and current status:
    Previous marriage:
I lived in USA with my valid H-1B1 working visa and my ex-wife had H-4 as spouse in USA several years ago. Then I filed the I-140 and I-485 for both me and ex-my wife for green card application and our green cards were approved by USCIS in 2010. After that, I divorced with my ex-wife.

    Current marriage:
Now I am having new marriage with my current wife. My current wife's status is H-1B1 working visa in USA, and my current status is green card holder (permanent resident) in USA.

    1. answer should be NA, unless your current wife has minor kid.
    2. I am not sure for this Q, because I am not aware in employment based GC who is sponsor for employee spouse GC. If it's employee or Employer.

But, I am positive when they mention if you filed petition - it means all kind petitions. Not just I-130.

What does the "place" exactly mean here in Form I-130

        For question #2,

        2. Have you ever before filed a petition for this or any other alien?
if "Yes,", give name, place and date of filing and result.

My questions: Does the "place" represent the place I was living when I filed my ex-spouse's I-485 or the place of the USCIS office where I filed my ex-spouse I-485 to?

Place is where you filed, not where you lived. Because it was an adjustment of status (I-485), it was probably USCIS - Chicago.

I130 Part 5 Have you Ever filed a petition for this beneficiary or any other alien?

              Hi,

I am currently filing for my mother for concurrent filing since she is here on B2 Visa. Please advise on how to answer this question, since I am not sure how to.

I130 Part 5 Have you Ever filed a petition for this beneficiary or any other alien?

I did file for a B2 visa on her behalf, which was approved. I filed for my brother for my wedding, but his was denied. Is that what they are asking about or is it i about if I have ever filed for a GC?

                No. An immigrant petition.

This is my personal opinion and is not to be construed as legal advice.
