My name is Nidhi Patel and I want to file a I-130 for my Parents. My dad is in the US since Nov 2015 and his visitor visa I-94 expire in May 2016. My mom is still in India and does not plan to come here until the I-130 approved for her. I am going to file I-130 along with I-485 for my dad.. The question is that in my birth certificate says my father's name is Jagdishkumar Patel and in his passport says Jagdishbhai... How do I go from here... Does he needs to go back to India to make petition of a name change in my birth certificate? or Can we can still file while he is in the USA. Does this name difference make a big issue? Please let me know how do we go from here. Thank you
