  • PLEASE help: GC for wife of GC holder (changed from L1 visa), confusing situation

Hello, our case is not as staright forward as many other cases. We are so confused and frustrated. Any help/advice would be greatly appreciated.

Both my husband and I are British (I was born in china but hold British passport only). We moved to US in 2010 (he had L1 visa, my son and I had L2). During our 3rd year in US, I had a good work opportunity working in china so I came to work in china with my son (on china working visas). During the time I have been in china, my L2 expired but I didn't do anything about it and his company obtained green card for him during this time. So to sum up, here is our messy situation:I didnt apply for green card together with my husband. His status changed from L1 to green card holder now, and my son and I are expired L2. Now our child is getting to schol age and our family also desperately need to re-unite for many reasons. His company lawyer sent out the paperwork for greencard for me and our son in November last year. In December my husband received a letter from USCIS, stating that the I-824 has been approved. And since then, we have heard nothing.

My questions are: Are we following the right process for our situation? what is going to happen next? His company lawyer said next the application will go to the embassy in the country where I live right now (which is china), then my husband will receive a notice asking him to pay, after he pays, the embassy will arrange interviews, then medical after that and the whole thing will take around 1 year. But it has been over 3 months since the I-824 has been approved and we have not heard anything from anyone. Could anyone advise us - how much longer do you think it's going to take? Is there anything we could do to speed up the process?

Thank you so much in advance...

Could someone shine some light? This is the wife. So far we have only received the I-824 approved. And it has been 3 months since the approved notice. It's an employment based petition, no I-130 required correct? When should I be contacted by the embassy in china?

    Thank you...
