I just got married to a woman that is a canadian citizen. She came here on vacation using her passport and we decided to get married. Now im not sure what to do. She wants to stay with me in the US but at the border they made her pay for a card that says she needs to be back by march 31 2006. I know i need to file an i-130 and she needs to file a 1-485. Can she stay here while they are being processed or will she need to go back to canada. I was thinking about getting an attorney but the one i talked to said it would be $2000 plus filing fees and I dont have that kind of money right now. Is that average for an immigration attorney? Any help you can give me on getting started would be great.

i'm not an expert, but
i do believe she'll need to go back to canada for consular processing. i'm canadian, and just filed for adjustment of status through marriage, but i'm here on a work visa, which means i'm here legally. it's a REALLY confusing process if you've never done it before, so i highly suggest getting a lawyer. (fyi, most of them offer free consultations.) perhaps your spouse can find a lawyer in canada that specializes in US immigration. that way, you can take advantage of the exchange rate. either way, you should shop around for a better price.
again, i'm not an expert, so i suggest you get at least one more opinion on this.

You do not need a lawyer. Just submit I130/485 forms and just wait.
I am Canadian/US citizen I filed I130/485 for my Canadian wife and children who were with me in the U.S.A for three years before filling the above forms. The whole process from filling to GC took only nine months.
