    Hello,

    My brother (beneficiary) will soon be applying for a resident visa through my mother (petitioner). My mother is elderly and doesn't have sufficient funds to meet the USCIS guidelines so I've stepped in as the joint sponsor. My questions are as follows:

    - Do my mother and I both have to fill out a I-864? Do I have to fill out a I-864A?

    - In Part 3 of the I-864 (Information About the Immigrants You Are Sponsoring), do both my mother and I choose "Yes" for Question #1 (I am sponsoring the principal immigrant named in Part 2)?

    Finally, what should I put for "Sponsor's Household Size"? 2 (my mother and I) or 1 (myself)?

    "If you have a joint sponsor, they must also complete Form I-864. If you are using the income of other household members to qualify, then each household member who is accepting legal responsibility for supporting your relative must complete a separate Form I-864A, Contract Between Sponsor and Household Member."

    You will need to put your income in your mothers I-864. And you will need to fill out an I-864A. This is a binding contract with your mother that you will financially support your brother. Your mothers I-864 will use your income.

    On the I-864, Part 3, section 1. Your mother will check yes, she is sponsoring the principal immigrant named in Part 2.

    On the I-864A, Part 2, section 1, you will check 1C, then check "son or daughter". There is not a place for you to check who you are sponsoring, you are just supporting your mother. Remember that she will still need to fill out and sign Part 5 of your I-864A and she will fill out the immigrants information there.

    You do not put anything down for your household size because it does not ask that on the I-864A.
    Your mother, on her I-864 will enter "1" in Part 5, section 1 (as long as there is only 1 immigrant (your brother) coming over).
    She will enter "1" in Part 5, Section 2.
    And she will enter "1" in Part 5, Section 7.
    The total number in Part 5, Section 8 should be "3"

    I am not a lawyer, I just made the mistake of having my dad, "co-sponsor" fill out a I-864A when we did not live together so my case got delayed. Therefore, I did a lot of research (and did more while answering you). Please do not rely on this as professional help. I am confident of my answer, but get some reassurance from someone.
