    Dear Inmigration Lawyer,

    I am 28 years old, and I am married to an american citizen; however, my marriage is going downhill. I work as engineer in USA for a big company.

    I have a sister, she is an american citizen, and she is in the process of asking for my mother to become a permanent resident.

    My mother can ask for her children in her visa application and my question is,

    Can I get divorce and re-apply to be a resident through my mother without loosing my job permit and leaving the country?

    do I need to get divorce before I apply through my mother?

    my advice; no stay married. it is better and faster since it will take you like five years to have an alien number throw your mothers petition and during that time you can't have a work permit or any thing.
