  • Need to Apply Visa for Husband

    Hi Everybody,

My family got green card visa before 1 year back. After 4 months staying in USA we got re-entry permit and came back to India. Now I want to set up marriage of my daughter (has GC). I want some guidance about following doubts.
    1. How can my daughter apply visa for his husband after marriage?
    2. For applying her husband visa she needs to stay in USA up to visa call will come out?
    3. How much time (approx) will take for finalization of her husband visa?

For more clarification, present we are in India and our re-entry permit is up to Oct 2017. Thanks a ton in advance for guiding.

For most insight on it and getting the visa approval for your daughter's husband, better hire a lawyer in USA. He will guide you perfectly on who's and how's of immigration law, as well as make things easier for you.

You don't need an attorney to apply for an immigrant visa for husband of your daughter, unless you have $2,000 or more to throw away, but your daughter's paperwork should be reviewed by an experienced third party before she submits it.

Experienced attorneys should be considered for any immigration "problems," but not for filling out a 2-page form.

After her marriage, your daughter needs to submit form I-130, with supporting documents for her husband. It will take about 2 years for the husband's Priority Date to be current. Your daughter should have evidence of maintaining a U.S. domicile or proof that she will be returning to the U.S. before or when the spousal visa is issued.
