I m US citizen. Dad in India. I have his marriage certificate from Indian embassy (Houston) which may or may not work, plan to get real marriage certificate in October(4 months from now) when my mom goes to India. I have 2 options:
1) I apply for his green card now in US (takes usually 9 mo if documents r complete)
2) Let him come on visitor visa in December and apply for green card couple of months afterwards (assuming he gets 6 months stay) so he doesn't need to leave while 485 is pending.
He recently stayed with me for 6 mo, left for 1 month and came back. CBP officer gave him only 10 days (as he came too early) and he left in 10 days. What do u guys think?
