I am a permanent resident in the US (with green card). I paid $3000 (just for the service) to a immigration law firm to apply for the green card for my son so he can join me (just he and not his mother).
The application was approved in January (according to USCIS website) and the law firm had received the notification end of Feb. However, they didn't take any action for about three months.
After I pushed them almost every day, they finally admitted that there was a mistake. They claim that it was USCIS that has made the mistake and put the mother of the child as the principal applicant. I don't buy into this claim as it should be the job of this law firm to submit a bullet-proof application so there is no room for any confusion and mistake. The only reason I paid them $3000 was to avoid such mistakes.
They then sent (after three months) a note to the NVC to correct the mistake and put my son as the principal applicant. The NVC has indicated that it would take 45 days to correct the mistake. That means, I will be using more than 5 months all together. I wanted my son to start the school in August in the US but with all these delays, there is no chance that he could get the visa before August.
I am not satisfied with the quality of the service this law firm is providing and also not happy with the speed they react. I believe that this law firm has violated the terms of the agreement I signed with them when I paid them the fees. In the agreement, it is clearly stipulated that the law firm would take actions promptly. However, the 3-month delay is a much longer time.
My questions:
1) what are my options? How can I deal with this law firm?
2) Ideally, I would switch to another attorney or just do it myself but I don't know if this law firm would refund the fees I paid. What would be the best way to do it?
3) Where can I file a complaint about this law firm?
Any advise / help would greatly be appreciated.
