  • My aunt who is an US citizen sponsored my father and us for US immigration

    My aunt (father's sister) who has been a US citizen for over 20 years has petitioned for my father and us for us immigration. My father (primary applicant) received a letter dated 21 July 2015 which said to apply for an immigrant visa within 1 year. Due to him being out of the country he received the letter a few months ago. We live in Bangladesh. As I was under 21 when my aunt petitioned for us, I'm eligible for US immigration as well. I am now 29 and have a husband and 2 daughters (5 and 3 years old). Can I include them when I'll apply for my immigration visa? Is it possible for my children to go with us as they are minors? Someone please provide me with the information. Thank you!

        Sorry, you no longer qualify for a visa since your are married.

        Your father would need to be an LPR for 5 years before he can apply for US citizenship. Once he becomes a US citizen, he can file for you. As a Filipina, it will take 20+ years to petition you.

        Also, you being under 21 when your aunt filed is not how your eligibility is measured. Age is counted as when the PD becomes current.
