  • USCIS can't find my I-130 7 months after receiving

    Hello,

I filed an I-130 (along with the other proper forms) for my petition for my husband's green card. They were all received on November 24, 2015. We received the receipts in the mail, and we have kept them, thankfully. Our I-130 exceeded the current normal processing times for where we live (6 months after receiving). We called a month ago exactly to inquire and file a service request. The request showed on our account, but was never assigned for processing.

We called today, after waiting 31 days at the advice of the original USCIS officer who filed the 1st service request. The agent today forwarded us to a second-level agent who was actually unable to even find the case. She put us on hold for about 10 minutes and said she checked on several different systems. The receipt number on the receipts we received wasn't tracking down the I-130 anywhere. She didn't know what to tell us to do next. She said she'd never seen it happen before... a case getting lost in the system. We had her file a different service request (because she was able to see the original one, but not the case). We don't know what to do now.

Has anyone else had USCIS not be able to pull up their cases? We don't know what to do.

Despite the agent's telling you he had never seen this happen before, numbers and cases become disconnected at USCIS on a regular basis. Usually they work out of the confusion and new status reports are generated. This most likely happened during transfer of the case to a different Service Center or to a local office for local followup because of some issue regarding your identity or peculiarities of your case.

You say you received "receipts," so this suggests you were also applying for Adjustment of Status at same time. Is this the case? If not, and your husband is still outside the U.S., what were the multiple receipts for? You should have received only one hardcopy receipt for your I-130 and maybe email or text confirmation that the I-130 was received.
