  • Got married in U.S. 60 days after entering U.S.

My husband is a British citizen. He came here in 2000 on a nonimmigrant L1 visa, which is up in Dec 2006. He has a daughter that is 7 that is a U.S. citizen. We had been together for 3 years when we opted to get married. He had to go out of the country in November for business. A week or so after he came back, he asked me to marry him and within 5 weeks we got married. The reason for getting at that time was because it was the only time during the next 6-months that all of our children would be able to be with us, etc.

We went to an immigration lawyer to file a change of status from an L1 visa to a marriage visa and we were told that we violated his visa by getting married within 90 days of his re-entry into the country. The lawyer said that they will pick it up during the interview and he will probably be deported if it goes in front of a judge.

Does any one have any suggestions?

I think you need to take a second opinion from a reputed attorney.
Because L1 is a visa that allows you to have an immigrant intent,
which means you do not violate anything by getting married to a US citizen.
