Can I apply for Green Card with Valid tourist Visa but Expired I-94 permit?

    Hi everyone,
    I am a foreign and I live in the US with tourist visa, I have like seven I-94 stamps in my tourist passport.
    My fiance and I are getting married in December 2016 in US. I have a valid Tourist Visa, but my I-94(6 months permit) will expire October 2016.
    Do I need ask for extend it or leave the contry before send the application? Or
    Can I stay here and apply for green card with the expired I-94?

    u shouldn't have a problem, just don't leave the country because u couldn't be able to come back in for 10 years or so for overstaying. i would get married and submit all the paper work. maybe i will just do courthouse wedding now submit the paper work then do the celebration in december

      once the application is processing ur status is legal. OPTIONS:
      1. leave the country before october reenter on finance visa, marry in 3 months= lengthy option
      2. leave the country before october apply for another visitor visa, come in at another state= lengthy option
      3. stay in usa, do court wedding asap, submit the paper work. do they fancy wedding in december. rushed option but possible
      4. stay in usa get married in december then submit the paper work, most likely it will be like late januray or so. these paper works are lengthy.=ok option

          once u entered the country legally, give uscis all their annoying stupid documents, pay the fees, don't travel until u receive ur work permit/travel document and interview date then u should be fine to put in the paper work anytime u want.
