  • filing for green card through marriage ( US citizen)

    Hi,
Im about to apply for green card as my spouse is US citizen. We have been married for 2.5 years. She is pregnant now. I came to US on H1B and overstayed for 2.5 years. I have couple of questions:

    1) Do I need to fill g325a for my spouse too (she is US Citizen by birth)?
2)For the fees shall I make a single cheque of the whole amount( Approx $2000) or attach individual cheque for each form ?
    3) My passport is about to expired in a week? Will it affect in any way ? ( I know I can file for renewal but wondering if expired passport has any effect on the processing.)
    4) We didnt file the tax jointly, nor do we have a joint account. But we had deposited money in each other account time to time( I have the receipts). Is it sufficient to show mingling of finance.

Below are the list of forms Let me know if I'm missing something
Also how to arrange the form and documents ?

    I-130
    I-485
    I-765
    I-864
    g-325a
    I-693

    Supporting documents:

    marriage certificate
    lease of apartment
    health insurance
    auto insurance
cellphone bills showing the record of calls and texts to each other.
photos of wedding and photos in general
    affidavits from friends and family
    I-94
Spouse tax information for affidavit of support
    passport copy

    thanks in advance,
    Zed

Short answer is yes, she is the petitioner and needs to fill out the G-325a just as you do.

      Help with completing Form-i-864

I am currently working in the US but applying for a green card through marriage. My spouse is a US citizen.
      Need clarification on form I-864.
      Part 5:
      1. 1 is me the immigrant
      2. is my husband who is the sponsor.
      3. We are married but he cant count me twice correct?
So total for 8. is 2.

      With regards to Part 6.
He will list his own individual income for the previous tax years.
However last year we were married but filed separately so will not reflect my wages...

Do we need to complete Part 6. No. 3? ie income you are using from any other person who was counted in house hold size, including intending immigrant.
Ie do we put my income here? (immigrant)
Do we need to provide evidence of continuing income from current source?

      Confused!! Please help!

Oh dear yes this is confusing, I'll walk you thru part V:
        Part 5:
        1. 1 is me the immigrant Correct! "Your spouse is only sponsoring you and counts you as #1 from Part 3 Question 28"
        2. is my husband who is the sponsor.????? "Part V #2 You are not sponsoring yourself, so count is 1"
        3. We are married but he cant count me twice correct? "You are currently married so you would count as 1
So total for 8. is 2. "The total is 3"
