  • court marriage before traditional marriage

    Hello all,

i am on a H1B visa and my fiance is a US citizen. we are planning to get court marriage within next month or so and traditional marriage next year December in India. Her parents are very religious and does not want us to move in together until after the traditional ceremony. My question is will we have difficulty proving a Bona-fide marriage considering the gap between court marriage and traditional marriage is 1.5 years on top she is not living with me ? the reason i want to get court marriage done early so i can get a another job and pay for my wedding.

    Thanks for all the help

This is a trick question as USCIS has a very rigorous criteria concerning legitimate marriage!
I am not an attorney and based on what your writing here my feeling is that you would be denied.
But since this a a non-consumate marriage it is best you seek the advice of an attorney!

one of thing uscis ask for at the interview is proof that u guys live together... 1.5 years is a very long time to wait. i will not submit the paperwork until u figure that part. ur wife need to pull up her big girls panties and do the right thing.
