  • Green card for family that entered legally but lost legal status

Hi guys it's my first time posting here and had a few questions.

I recently enlisted in the Army and will be getting the citizenship within the year and I want to sponsor the rest of my family.

My brother is here legally through DACA however my parents entered the US legally but their VISAs have expired.

It it safe to file I-130 for them, and if it is can they file the I-485 concurrently?

    Thanks you!

Normally the citizen petitioner can petition and adjust parents, spouses or children under 21 who entered the U.S. legally.
