Filing I-130, I-485, I-765, I-864, g-325a, I-693 all at once for my Husband

    Hello beautiful people!

    I am petitioning for my husband. My question is regards the I-864. We are combining our incomes to meet the income requirements. Based on my research, we are not required to fill out the I-864a since my husband is the intended immigrant and has no accompanying dependents. Is that correct?

    Now, hat do I choose under Part 1 on the I-864 form?
    Would it be 1.a.?

    If your husband has approved work status, and you are using him as your household member co-sponsor, he needs to include an I-864A with your sponsorship package. If your husband does not have Work Authorization, you cannot use his "earned income" for his sponsorship.

      Also with legal work status he has to prove he worked 40 quarters if you want to include his income.

        I am also in the process of filing and after long research realized that I have 40 Quarters and do not need my husband as a sponsor. If combining the quarters I believe that the sponsor and beneficiary need to have been married during the time the quarters were earned .
        I believe that work authorization is not a factor. Or at least this is what I was advised by an attorney.
        If you have a SSC with your name
        Report from SSA that shows 40 quarters
        attach W-2s ( I did last 6 years )
        I would like to learn more. I was confused when attorney told me not to quit my job and it's OK to apply with I 864W knowing I worked without legal permit
