    Hello Everyone:

    I will become citizen soon.

    I will be filing I130 for my brother and sister ( F4 ).
    Current wait for I-130 approval is about 5 years and F4 has a backlog of over 12 years.


    My question is:

    1. Can I file for I-130 for my brother ( F4 ) and leave for India after getting receipt ?
    What are, if there are any, issues in petitioner staying in India while I-130 is getting processed ?
    Does petitioner need to be in US when petition is approved ?
    2. Can I-130 for brother or sister be filed while petitioner is in India ( similar to Direct Consular Filing for spouse )
    3. What do i need to do to make sure I-130 approval is received by me if I am in India ? Can I get that in India ?
    4. Once priority dates are current, and consular processing starts, does peitioner need to be in US at that time ?

    1. You can be in India. No problem.
    2. No. That is only for spouse.
    3. You can't get that in India.
    4. No. You need to be domiciled in US.
