    Hi, I am currently planning to apply for marriage-based immigration to the US, but I have a question wrt the financial requirement. Me: applicant. Spouse: US Citizen.

    I am currently on F-1 student visa. My spouse made 15K, 18K, 25K in 2013, 2014, 2015. My income was 0K (master's degree), 30K (phd), 30K (phd) in 2013, 2014, 2015. He's projected to make another 25K in 2016, and me 30K. We are married and living together and my income won't get affected by the change of my immigration status (meaning my income can be used to meet the income requirement)
    We don't have any financial problems, and my degree will guarantee a job with min 100K per annum starting next May/June. His family cannot help us financially. We don't have any asset, but I do have around 50K in my saving's account under my name.

    So here's the issue.
    We can wait till next year to apply. By then the most recent 3 years will be 14, 15, 16. Our joint income will surpass the poverty guidelines plenty. But he doesn't want me to wait, and it would def make travel plans a lot easier if we could get it done as soon as possible.

    My questions:
    Is there ANYWAY for us to apply NOW? Our joint income was not sufficient in 2013 only, when I was living on savings and he had a crappy part-time job back then. Will this affect the validity of the application? Can my savings account help? How much asset do we need if the savings account is not enough (to make up for 2013 essentially).

    Any advice will be tremendously appreciated! Thank you all in advance!

    It matters what he makes now not years ago. Since his current income is above the poverty line for 2 people then it's fine.

      I didn't know that lol. So I can just apply now? I thought his income had to surpass the poverty guidelines in all 3 years reported.

        I didn't know this actually. did anybody know of anyone who applied with insufficient income in previous years??

          Contact USCIS

          I believe (my opinion) is that with your current asset of $50,000 as well as 2 years of returns should be able to fit the financial requirement. However, I would still double check before proceding. I am not sure how much USCIS can help, but they do have local application support offices. I hope one is near enought to you.
