  • Request For Evidence Problem

    My priority date is 11 April 2016.
    On 16 August 2016 while checking in the USCIS website I saw that my case required evidence to submit.

    My Question is :

    1. Will the processing time for RFE count for CSPA Calculation?

    Don't know why they asked for RFE though my mom submit all the documents properly..

    I didn't get the notice. Expecting to get soon.

    Pls answere my question...

    1. Will the processing time for RFE count for CSPA Calculation? NO the processing clock stops! USCIS will start processing your petition when they are satisfied with your response for evidence.

      I thought that once you get the I-797C (Notice of action) with priority date on it, means they are satisfied with the evidence you submitted and hence put you in the queue with a priority date otherwise they would have simply asked you to submit more evidence and not given a priority date. Maybe I am wrong, can someone clarify.

        In responding to Talha's question regarding a pending case, no matter the petition when an "Request For Evidence" is sent USCIS suspends the process and in some cases if the respondent fails to reply by the date on the RFE Notice USCIS will close the case because of abandonment. If the respondent satisfies the RFE in the alotted time to USCIS's satisfaction, USCIS will resume the process.

            Provided USCIS is satisfied with the provided documents/evidence the processing continues. The answer to your question is YES.

              Is that mean after sending the required documents the time that they will take to approve will be added with the actual processing time?

                What is USCIS requiring for evidence?
                Have you turned 21? Have you missed the deadline and "Aged Out" of CSPA?

                The main answer to your question is yes! USCIS usually ceases processing an application/Petition while awaiting an RFE request.
                When you/Sponsor sends in the requesting evidence they begin processing from where they left off.
                I am not an attorney, so I can't give you an answer about adding the time the Child Protection Act.
