my uncle petitioned for my father(57) and mother (52) and me(24) under F4 category in May 2003.

You need to query the NVC, online, and ask for an eligibility determination for CSPA benefit eligibility. It will take a couple of weeks, but they routinely handle this kind of request. I believe that if you turned 21 before your Priority Date became current, you probably won't receive any shortening of waiting time.

hello people,
my uncle petitioned for my father(57) and mother (52) and me(24) under F4 category in May 2003.
Petition date - May 2003
Approval date - June 2009
visa bulletin current date - feb 2016
application(ds-260) filed for my father and mother in feb itself and NVC did not generate an invoice for me but my name appears on the ceac site as Follow to join N/A under IV fee.the invoice was generated for my parents but not for me.
My current age is 24 and i want to know whether do i qualify under CSPA act and still legally apply under the F4 category with my father and mother?
please reply asap and let me know what is the process to obtain the invoice and apply?
PS - My parents fees are already paid and ds260 submitted.

i will send them the cover letter.but according to cspa you need to "seek to acquire" within 1 year of your visa bulletin becoming current that is feb 2017.the visa awaiting period was 6 years from 2003-2009 and i can subtract that period from my current biological age.

Hello akash, u dont have to worry! I am on the same boat as u! Bt one of my friend who was in the same situation got his visa, his age was 26 at that time though, he managed to get the visa! Bt check with bulleting as india's priority date retrogressed to 2001! God knows when it becomes available from july 2003? Any idea or any letter from nvc that give u roughly estimation about when you will have your interview?

yes.its a temporary thing.65000 applicant for the fiscal year oct-sep has completed so no movement till month of september.October marks the new fiscal year with new 65000 applicants.The date will become current from where it was left i.e 07-22-2003.when is your priority date? and approval?.hoping for the best. lets see what happens.

NO my invoice was not generated but the application for my father and mother is completed and we are waiting for interview date.if cspa applies to me.they will update my status to accompany and i can go to the interview with them on payment of fees.

My pd is sept 2004, as i am in usa on student visa m hoping to apply for adjustment of status! Do you have any idea about dates for filling for f-4 prediction! I mean they litterally didnt move after jan 2016, m just loosing my all hope now ! God know how much time it will take more !

it will take another 1n half years most probably or may be 2.they did move but stopped after june.

I got you, bt i am talking about the second chart regarding adjustment of status for those who already are in us on legal status! The category generally 6-8 prior than the genral one!

still it will take another 1 1/2 - 2 years as both the charts cannot be used as of now.final action will be used everytime.

I am in same trouble. But its seems that from 1 OCT 16 it is start from JULY 2003.

My dad's priority date is APR 2004.

Thanks for your reply.

But my CSPA eligibility will expired after OCT-17. What should I do? My name is not there in D260 form with parents. My agent suggest me that once your file become current then and only then the will consider your CSPA application.

B'day APR 1991.
PD APR 2004.
Approved OCT 2009.

How CSPA works for me?

What to do? Please help me?

Contact nvc to submit ds-260 as india has adjustment of status dates of may 2004 , which is not current at this point! Bt it will be after october,hopefully! if your dad has b-1/b-2 visa , he also can file for AOS that way u can be elligible before your expiry of cspa! I recommend you to hire an experience attorney if needed!
