Sponsoring a Son Born Out of Marriage and Who is Over 21

  • Sponsoring a Son Born Out of Marriage and Who is Over 21

    My dad would like to sponsor my half brother born out of marriage who is now over 21 years old. My dad's full name and his mother appear on his birth certificate. What will be the process? Does he qualify to be sponsored? Please help with any guidance.

      Besides birth certificate and evidence that my dad is the father, does he need to submit additional documents along with the I-130 such as two 2x2 passport photographs(petitioner and beneficiary), G-325A(petitioner and beneficiary), copy of Naturalization Certification, and copy of passport for the beneficiary? What are the documents needed along with the I-130 forms?

        Did the father naturalize before or after the child was born?

        Was the father in the child's life as he grew up?

          Thanks for your response. Father naturalized after the child was born and father has always been supporting and taking care of the child.

              See I-130 instructions. For proving the relationship, if the child was legitimated (e.g. by the parents marrying) before age 18, provide proof of such legitimation. if the child was not legitimated, provide evidence that a bona fide relationship existed between the father and the child before the child turned 21. For proving the father's US citizenship, provide either his Certificate of Naturalization or US passport.

                I don't see list of documents from the I-130 instructions other than providing evidence that relationship existed between father and son.
                Does the sponsor need to submit 2x2 passport photograph for both(father and son)? Does he need to provide a copy of his current marriage certificate as father was married to a different woman? Any other documents other than evidence that a relationship existed between them, and his Certificate of Naturalization/US passport?

                  No, that's it. Note that the birth certificate with the father's name on it can form part of the evidence that a relationship existed between them.
