My father had filed an application I-130 for my brother in February 2005. At that time he was unmarried. He got married in 2008. So from F1 his priority moved to F3. My brother currently holds an Indian passport. With the new visa bulletin, we are confused whether we should be looking at the final action dates chart or the date for filing visa application chart. The final action date gives a cut off date of December 1, 2004 whereas the date for filing visa application has a cut off date of August 22, 2005. Does this mean we can file the I-485? Do we need to wait for USCIS to send us a letter/notification before we can file?
The application was filed with the vermont service center. My family has subsequently moved to California. Where would they need to file the adjustment of status?
