    Hello,

    My family's F4 visa file is currently open. We live in Canada and are currently Canadian citizens. My parents were denied entry/withdrew entry (they don't know) at port of entry - Canada-US Land border more than 10 years ago. Their finger print was taken at that time (that's all my parents remember). They were Indian citizens at that time and had an Indian passport. My uncle (who lived in the US) passed away, and my parents wanted to attend his funeral. They did not have a visitor visa, and could not wait for visitor visa. We were new in Canada and someone had told my parents that if you go with proof of funeral and don't lie, they will issue emergency VISA at the border and will allow you to enter US. My parents had left me and brother here in Canada, and planned to enter US only if they obtained the VISA and return back to Canada within a day. At the border, they did not issue the VISA so my parents were told to go back to Canada, they were not given any paper stating the exact reason. When we became Canadian citizens, we went to visit my aunt in the US with our Canadian passport, and had no problem at the border. After that we have visited US every year since past 8 years without any issue. My question is: Is this going to cause further problems when we submit the F4 immigration forms. Would this result in denial of F4 visa?

    I am not an attorney but I think the issue was the Indian Passport. I to am a Canadian Citizen travelling under a Canadian Passport and never have an issue with border crossings.
    The only thing I can suggest is to apply under FOIA AKA Freedom of Information Act at USCIS and here is the link. Take time to read the specifics, the more info you put the easier it will be to locate.




    P.S. your parents were issued an I-94 document or stamp in their passports?

      Hi Adrian, Thank you for replying. I will look into FOIA. I checked their expired Indian passports, and they don't have any markings/stamps from US immigration, and they did not receive any documents either (so no I-94). It's a big mystery. As far as i know (from searching on google), when someone is denied entry, US authorities issue some kind of documents stating the reason, which wasn't the case for my parents. I wonder if NVC would be able to help with this - i highly doubt it.
