  • I-130 Question 22 Parents

    Hi Everyone,

    I am filling the I-130 for my parents who are currently outside of the US and they don't have a visa to enter the US. I am a little confused about question 22 which states in bold:

    "Complete the information below if your relative is in the United States and will apply for adjustment of status. "

    Then there are two parts (not in bold):
    "
    (a) Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: ______ City ____ State

    (b) If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in: _____ City ______ Country."


    I know part (a) doesn't apply for my parents, so I filled in N/A. But what confuses me is part (b), my parents are not applying for adjustment of status, do I fill in the preferred embassy they want to do the meeting at, or should I just leave it blank since the main question states "Complete the information below if your relative is in the United States....."

    I am sorry for being tedious, but I want to make sure everything goes smoothly. Thank you very much for you help!

    The question you have pertains STRICTLY if your parents are in the USA. My understanding is that your parents are not in the United States. Therefore, you would want to mark all the questions in this section as N/A. Putting in anything than that might confuse things as USCIS may think there are indeed in the United States. That of course can generate unnecessary delay.
