    Hi,

    I am a US citizen and want to file GC for my mom. She is currently in US on tourist visa. She came to US in August and is living with my sister in Chicago.
    She will visit me in CA in November. My questions is should I file i 130 right now and file her i485 later when she comes to visit me in 3rd week of November?
    I know i can file i 130 and 485 concurrently in end of November or 1st week of December completing her medical exam etc after thanksgiving break when she visits me but What should be better for speeding up the process?
    Filing i 130 now in Oct 2nd week and 485 in Nov end or filing i130 and 485 concurrently in Nov end?
    Also is it advisable to file i130 in 2nd week of Oct as she came to US in August End? I read somewhere that we should wait 30-90 days?
    Pls advise!

    File them both together now. Otherwise you will have to wait until I-130 is approved before you can file eh I-485. Fees for the I-485 are expected to go up in October, significantly.

      But a lawyer told me to file i 130 right now and file i 485 in November as my mother is in Chicago right now and will visit me in 2 nd week of November. Can't i file 485 a month after filing i130? I read somewhere that we dont have to wait for i130 approval for filing 485 as dates are current for parents category. Also is it advisable to file for GC only after 45 days of her arrival in US?

        Well, you so far have three advices on when to file the I-130. If you file the I-485 without the I-130 being approved or included n the same filing, you may have a problem. If your mother is in Chicago, that means she is in the U.S. and you don't have to wait until November to file her I-485. But sine November 8 is only 5 weeks away, it doesn't make much difference if you file the I-130 and I-485 (together) tomorrow or 2nd week in November.

          The only thing is i'll need to get her medical exam done and get signatures on 485 . Can she get her medical exam done in Chicago and send me signed 485 forms and I file from my CA address?

              RayB is correct, I did not file concurrently due to lack of resources! I filed my I-130 in 01/05/16 and it took 5 months for approval! The only benefit was that I got an early Priority Date for my I-485 which I filed in 07/05/16. So my I-485 Priority date is 01/05/16. If I had the money I would have filed together.
              One thing of Note, I have seen folks here in this forum file their medical reports after they already sent in the AOS papers.

                Thanks Adrian! I also want to know if submitting my birth certificate which i got from municipal corp Delhi in 2013 is good enough to submit which shows my dad and mom's name. Also showing same last name that i had before marriage. After marriage my last name was changed, do i need to submit anything else also or just my birth certificate and may be additional 10 th certificate is enough.
                Also i got ' NABC' for my mom from the place she currently lives and not from the place of her birth , is that ok?
                I also got two affidavits from older relatives though?
                Pls advise!

                  USCIS is vwey particular about foreign documentation! Make sure whatever your documentation is, it has to be in english or translated into english.
