USCIS sends me to NVC, NVC sends me back to USCIS

  • USCIS sends me to NVC, NVC sends me back to USCIS

    Jan 2011 - green card holder files I-130 for his unmarried son over 21 years old. We put both american (for AOS) and foreign (for visa) cities in part 22 of the form.

    Same month we get NoA that documents were received

    Sep 2013 - we get Approval, that offers to file either I-485 for AOS or I-824 for visa processing. We did neither, as it would be too early (and still years to wait for available visa number)

    Oct 2013 - applicant becomes US citizen

    Nov 2014 - son gets married, documents about this are sent to NVC, but there was no clear reply from them

    Now we want to know if they have correct preference category on file. Initially it was (F2B) Unmarried Sons and Daughters (21 years of age or older)of Permanent Residents
    and now it should be (F3) Married Sons and Daughters of U.S. Citizens.

    And now the problems started. We sent email to NVC, but they say we have to contact USCIS:

    The Approval Notice indicates the principal applicant will adjust status in the United States. Your petition is at the U.S. Citizenship and Immigration Service (USCIS) office. Please contact the USCIS office where you filed your petition.

    But after calls, letters and even appointment in USCIS, USCIS says that they sent documents to NVC, and we have to contact NVC.

    We called NVC, and they send us back to USCIS. Circle is closed now. What can we do?

    Check the Priority Date for your son's new visa class, resulting from his marriage and acquired naturalization of the petitioner. When his new visa class is "current," apply for Adjustment of Status in the U.S. You have no reason to deal with the NVC, as they do not have jurisdiction if AOS processing will be in the States.

      No, it's still 6 years away from being current.
