  • Traveling out of USA and coming back on F1-visa before getting married

    Hi,

I'm currently here studying at a college on F1-visa. I got engaged to a US citizen about 2 months ago. I'm planning to go home on my F1-visa during my winter break for 2 weeks to get my birth certificate and other paperwork; after I come back to the US, we'd get married. I've heard it's not recommended to travel out of US after getting married and before applying for a green card, but I'm not sure if there would be a problem if I travel BEFORE I get married. I already bought flight tickets and I really need to go home this winter, but at the same time I'm worried that it would make it more difficult when I apply for a green card. I understand that I won't have any problem entering US since they won't know about me being engaged to a US citizen if I'm not married. However, when I apply for a green card, they will ask for the last date of entry and if they look at the marriage certificate, would that make them think that I traveled to the US using my F-1 visa only to get married? Thank you.

I won't be so sure that you "won't have any problem entering US since they won't know ...". It's always a dangerous path to gamble on them not finding about something. But that's your choice.

If they let you in, and you didn't lie, your adjustment of status is not going to be denied for this reason.

Thank you for your comment. I got in without a problem and they never asked me about anything regarding marital status. I got married the day after I came back. When you said as long as I didn't lie, did you mean to say that I should tell them the truth about traveling outside the US before I got married when they asked me?

Didn't lie means you didn't tell them something that is not true. But that doesn't mean you have to tell them things that they didn't ask about.
