  • Need Assistance Completing Affidavit of Support

    Hello All,

I have a cousin who is a US Citizen living in the US with her 2 children. She is only sponsoring her husband to come to the US. When filing the Affidavit of Support(I-864), are considering her two children when referring to the sponsor’s household from the Poverty Guidelines(I-864P). If she does not meet the minimum income requirement and needs a joint-sponsor to assist, are we still considering her entire household for the joint-sponsor? What will be the minimum income requirement for the joint-sponsor?

    Thanks for your assistance.

yes! the joint sponsor income has to support her, the kids, plus co sponsor =$30,375 this figure isn't included that co sponsor house hold members

I have to disagree with the response regarding a sponsor. The joint sponsor only has to meet sponsorship requirements for his own household members and the single immigrant.

Thank you all for your response. Would you be able to provide the source(link/site) referring to the matter?

The co-sponsor is only sponsoring the immigrant, not the other members of the primary sponsor's family. So the co-sponsor should only list the immigrant and the co-sponsor's family members in his I-864.

Thank you all for the response. I just have another question.

Can two joint-sponsors combine their income to meet the required income? The sponsor herself does not meet the requirement. Sponsor's brother also does not meet the requirement, but combining sponsor's brother income with his mother's meet the requirement. What do they need to fill out I-864A?

            Please advise.

            Thanks.

              MoozB,

One co-sponsor using I-864A (and listed on primary sponsor's I-864) or the co-sponsor using his own I-864, are recommended ways to handle this.

Two separate I-864A's (when accompanied by an I-864 from parimary sponsor), or one I-864 for primary partner, and an I-864A for second married partner, from married partners are also standard.

                Hello All,

I was completing I-864 form for my cousin. I have question regarding Part 5(Sponsor's Household Size). Item #3 states to enter 1 if you are currently married. I entered 1 as she is married. In Part 3, item #28 states to enter the total number of immigrants you are sponsoring. I entered 1 as she is only sponsoring her husband. However, total household auto-populated as 5. Her total household size should be 4 as she only got two daughters, herself, and her husband. Application is auto-populating and counting her husband twice. Any advise on this?

                Thanks,

She should never count someone twice, so she should put 0 for spouse instead of 1.

                    MoozB,

The total household size for the I-864 you worked on should be 5, which includes the applicant, your friend, your friend's husband and two children. The total household size includes the immigrant.

The friend's spouse IS the immigrant.

Right, so she should not check "spouse," since she is duplicating the household member count. The I-864 instructions specifically say that if the immigration being sponsored is the sponsor's spouse, the the married question should not be checked.

I was confused and assumed the sposored party was not the spouse.
