My wife is a GC holder and wants to apply for me.

  • My wife is a GC holder and wants to apply for me.

    My wife is a active GC holder. She currently stays with me outside of US.
    She will travel back to US to settle there.
    Can she apply for GC for me as soon as she travels back to US?
    Would she need to show any financial balance that shows that she can support me?
    How long would the GC process take before i can get the green card?
    Is there any other VISA i can apply while my GC is in process so that i can travel and stay with her and also get a work permit?
    What all documents would be required for the GC application process?



    Thank you , in advance .. too many questions but would really be help full if can get some comments.

      Yes your wife can file for your green card petition as soon as she come's back to US.

      To sponsor you, her annul income has to be at least $20,025 (For two people, according to 2016 poverty guide line). If she don't have a job yet or her income is not sufficient she can get a co-sponsor also.

      After filing the petition, it will take at least two years before you get your immigrant visa from US embassy.

      You can apply visit visa ONLY. If you come to US on visit visa then make sure that you don't overstay. No you don't qualify to get a work permit.

      You need to file I-130, one G-325 for you and one G-325 for your wife also.

      If your wife's income is enough to qualify then she will file ONE I-864. If there is a co-sponsor then that person has to file I-864 as well. (You don't need to send I-864 with your I-130 petition yet,you will send I-864 to NVC when they will request it on a later date)

      You need one passport photo of your self and one for your wife,your marriage certificate,your birth certificate (with notarized English translations, if these documents are in local language) and copy of your wife's GC to file I-130 petition for YOU.

        How best to choose a attorney if i choose to take a VISA attorney help?

          You can get a second sponsor from ANY BODY. As long as that person is a GC holder or a US citizen.

          Filling I-130 is a simple process, so in my opinion you dont need help form any attorney in this regard. Just read and fallow the instructions on these forms that I have mention earlier and you will be able to do the whole process by your self. (But in the end it's really up to u)
