  • Working (Visa - without work permit) and applying

Has anyone experienced this? I am on a F1 Visa and I lost my sponsor on September. On October I had to start working to keep school going. I married to an US Citizen on November. I am still working without the permit (I receive checks on my name). We are going to be applying but we don't know what exactly to put on the i-130 for my last work location. Someone help me, please? Is it a big issue?

Answer everything truthfully. It will not affect your AOS.

How is your employer allowing you to work? Are you working as a contractor and thus don't need to fill out an I-9? Make sure you absolutely never claim to be a US citizen on any form as that will lead to a lifetime ban with no waiver.

This is my personal opinion and is not to be construed as legal advice.

Hello. My employee knows my situation. She helped me and she does not have me on the payroll. She is aware that I am on a Visa.
