I130 question

Hi,
I am a US citizen, and my husband is applying for his Green Card. I have a few questions-
1. In the I130 form, there is a question 14- "If your relative is currently in the US, complete the following- He or she has arrived as a (visitor, student,..... etc).
My husband arrived in this country as a student, but is now on H1. He has been on H1 prior to us getting married as well.
What should the answer to this question be- Student or Temporary worker?

2. EAD can only be applied with 485 right? The EAD that we apply for while we apply for OPT is different than this right? There is a question that says "Have you ever applied for your EAD?" What should the answer be for this?

**** Question 14 is in 3 parts: Answer the first part as a "STUDENT" as he came in under legal Inspection!
the second part of question 14 deals with his I-94 which can be 1 of the following: Paper receipt, a stamp in his passport or electronically in any case you must enter the
the numbers in the second part of q-14, and the last part enter the epiration date on the I-94

If you applied for OPT before, the answer would be Yes.
