I-130 / I-485 Acceptance time frame...

  • I-130 / I-485 Acceptance time frame...

    I am not talking about approval time frame... I am talking about acceptance by USCIS / acknowledgement timeframe assuming everything is in order with paperwork...

    My mom's stay is stamped till end of Jan 17 only... Visa itself is valid for few more years...

    I need to receive the acceptance/acknowledgement from USCIS before the end of her stay isnt it once I send my packets right?

    I am planning to send the paperwork by courier tomorrow to USCIS and it may take a day or two for them physically receive it...

    Is it too risky for me to send the packets now (as it is only few weeks of stay remaining for her here in US) ... Is this enough time to receive the acknowledgement?

    Do you know how long it takes typically for USCIS to send an acceptance of I-130 ?

    Hope my question is clear...


    Please let me know. Kind of urgent...

    If you are talking about the receipt of application, then it is *about* 2 weeks or so. You may get a better idea by looking at other people's timelines as in here:

      Once the application is received (as in a case # is created I supposed and I-130 will move to pending I guess) she will be able to stay in US correct?

        First, you don't need to have received acknowledgement for her to be able to stay in the US. She can stay in the US as long as USCIS officially received the application (the received date), which is going to be the date in which the mail is delivered to them or one or two days later at most. If you have tracking on your mail then you know that it was delivered. You just won't have proof that they received it until you get the receipt, but not having proof doesn't mean they didn't receive it.

        Second, it doesn't matter when the application gets to them at all. It could get there after her status expires, and it wouldn't matter. Her status could have expired years ago, and it still wouldn't matter one bit for her application for Adjustment of Status. As she is in the Immediate Relative category (spouse, under-21 unmarried child, or parent of US citizen), she does not need to be in status to be eligible for Adjustment of Status.

          my packet was delivered to US on 12/29/2016... I have not gotten the official communication / acknowledge back... Hope I will receive that in week or two..

            I sent my packets I-130/I-485/G-1145 on 28th... USCIS received it on 30th Dec at the South Dearborn Chicago address... I have not received any email/text/mail notice yet, and the check for i130/i485 check is not cashed either...

            Is it too early to expect a receipt? My mom's visa is valid only till end of January 2017...

            Based on what you said earlier, I won't have to file an extension to her stay correct? Given she is immediate relative and also that I have the acknowledgement that I sent the packet?

            This would apply even if they return my packet for some reason and I have to re-send it again past her I-94 expiry date correct?

            just reconfirming, as this stage is the most difficult, always keeps me on the edge/fingers crossed..
