    Hi, what will happen if a IR1 greencard holder for few month of getting card want to devorce her husband and want to marry another person & want to take him to her in USA.?????? Plz ans...

    On this forum and other forums, there are people who mentioned they were questioned about their previous marriage when they went to interview for second marriage based adjustment.

      How long have you been married? Are you already "dating" the other person? It could be suspicious to a VO to see you divorce then immediately marry someone else who also needs to be sponsored for green card. And yes they will ask many questions about your divorce.

        Someone who immigrated as a spouse within the last 5 years and who has not yet become a citizen cannot petition for another spouse unless they can show by "clear and convincing evidence" that they did not enter into the prior marriage for the purpose of evading immigration laws.

        This is my personal opinion and is not to be construed as legal advice.

            Married for about 3 years, 2 years living home country without husband & 1 year in usa together.. Now at hometown.. The marriage was arranged by family, but she is physically & mentally having so much problem when she start to live usa together... Now she is in home country & want to divorce, but not yet any date, just asking bcoz she will have today or tomorrow.. Plz advice me.
