  • Affidavit Sponsor?

    Hello everyone,
Two weeks ago me and my fiancé decided to get married and start the green card process to fix my stay in the United States.
We are about to fill the forms necessary and send it to USCIS but we don't want to get rejected on the affidavit situation.
My now wife used to have a job during 2016, making enough money to sponsor me. Now she is looking for a better job.
'My question is: "is her last year employment record enough to sponsor me? Do we need to wait ultil she gets hired? If she does, how long?

    Thaks in advance!

    Affidavit Sponsor

The method of evaluation is her tax filings from last year. So if that indicates her previous employment (with adequate funds), that should suffice. Has she quit that job or is she "looking" for a new one? If she is still employed there, and if at all possible, have her maintain that employment till the process gets started and approved.

You can switch jobs. People do it. But that adds further complexity. She will need to disclose her current employment as well as her previous employer, alongwith an offer letter proving that her new income will still satisfy the requirement.

If in doubt, please consult an immigration lawyer. You can do a one time consultation to review everything (highly recommend). Yes, you will have to pay for that service, but this is a life altering decision, and you want to do it right

    Good luck!

What matters is the current (this moment's) income. Not last year's. Not last month's. Past or future income are not counted. If she is not working right now, her current income is 0. So you will have to wait until she has income again, or use assets, or find a joint sponsor.

This is my personal opinion and is not to be construed as legal advice.
