  • DACA Recipients (Family Based Filing)

    Hello all!

I'd like to share my experience and where i am in the whole process so far...

-I've been a DACA recipient since 2013 to present, I married my US citizen wife last September after 3 years of dating. I filed concurrently (i-130, i-485, i-131, i-765) back in November 2016.
    - Received RFE in the mail 12/23/16
    - USCIS received RFE: 1/12/17
    - BIO Done: 1/19/17

I haven't heard anything since then, and status still says "case received". I have a trip planned for mid March, I'm hoping to get my EAD/AP combo card before then, otherwise I will have to postpone my trip to a later date. Wish me luck and good luck to you all!

    Hello,

Do you know if DACA recipients who are in the process of applying for AOS (marriage-based) will be safe to travel outside the U.S. with an approved EAD/AP combo? Is it true that it's not guaranteed entry back into the U.S. for DACA recipients while AOS is still in process? From my understanding, anyone with legal status or valid visa applying for AOS can travel outside the U.S. with EAD/AP combo and return to U.S. without any problems, but DACA recipients can't travel outside the U.S. unless they have an approved AP for humanitarian/education/work reasons. So I am wondering if DACA recipients who are in the process of AOS are safe to travel for fun with EAD/AP combo. Have you heard anything about this?

If you end up traveling in March, can you update your experience with U.S. Customs? Good luck!
